The service
These terms govern your use of 1099SmartFile, the information-return e-filing service operated by SSA Technologies LLC (“we”, “us”, “our”). The service lets you prepare, e-file, correct, and deliver Forms 1099, including recipient copies by email or by print and mail when you select those options.
1099SmartFile is a software service. We do not sell physical goods, and we do not operate an online store. Payments for the service are processed by Square. We do not store your card number.
Your account
You must be able to form a binding contract to use the service. You are responsible for the accuracy of the payer, recipient, and payment information you submit, and for filing by the deadlines that apply to you. The service does not provide tax, legal, or accounting advice.
Keep your login credentials confidential. You are responsible for activity under your account, including activity by people you authorize, such as staff of an accounting firm filing for clients.
Filing and corrections
We transmit filings to the IRS, and to states when you select a state-filing option we offer. Acceptance by the IRS or a state is not guaranteed. If a filing is rejected, you can correct the data and resubmit it. If a filing has been accepted and the data needs to change, file a correction.
You must furnish recipient copies when the law requires it. Print-and-mail and email delivery are optional services you select at submission.
Fees
Fees are shown on the pricing pages and in the application before you submit. We may change prices, and the price in effect when you submit an order is the price for that order. There is no separate shipping charge. Print-and-mail, when selected, is a service fee, not shipment of a product you purchased.
Acceptable use
Do not use the service to file false information, to break the law, to interfere with the service, or to upload malicious code. Do not attempt to access another customer’s data. We may suspend or close an account that violates these terms.
Privacy
Our Privacy Policy describes how we handle personal information, including taxpayer identification numbers. It is part of these terms.
Disclaimer and liability
The service is provided “as is.” We do not warrant that filing will be uninterrupted or error-free, or that a tax agency will accept a return. To the fullest extent permitted by law, SSA Technologies LLC is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the service. Some states do not allow certain limitations, and in those states our liability is limited to the maximum extent permitted by law.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. SSA Technologies LLC is located at 412 Arlewood Ct, San Ramon, CA 94582.
Changes
We may update these terms by posting a new version on this page. Continued use of the service after the new version is posted is acceptance of the updated terms.
